Accepting these terms
These terms cover your use of the Williston Concrete website and any estimate, quote or work you get from us. By using the site, calling us or booking a job, you agree to them.
If you don't agree, please don't use the site or book work with us. A signed written agreement for your job wins over these terms wherever the two differ, because that agreement is written for your property and your project.
What we do
Williston Concrete is a concrete contractor in Williston, ND. We pour driveways, patios, sidewalks, steps, garage floors, slabs, footings, foundations and other flatwork, and we offer stamped and decorative finishes, retaining walls, concrete cutting and foundation raising. The full list is on our home page, and you can read about our crew on the About page.
What the site says about each service is general information to help you plan. It isn't a promise that a given method, finish or schedule fits your job. We confirm that once we've seen the site.
Estimates and pricing
Estimates are free and done in person, with no obligation to hire us. An estimate is based on what we can see and measure that day, such as the size of the area, the condition of the ground, access for the truck, demolition of old concrete and the finish you choose.
Some things only show up once the old slab is out or the digging starts, like soft or wet ground under the slab, buried debris or roots. If we find something that changes the work or the price, we'll stop, explain it and get your approval before we go ahead.
Unless the estimate says otherwise, it stays good for 30 days, because material and delivery costs change. Any price on your estimate covers only the work written on it.
Scheduling, weather and cancellation
We schedule pours around the weather, because rain, freezing temperatures or extreme heat can weaken a slab or ruin its surface. If conditions aren't right on your date, we'll move the pour to the next workable day and let you know as soon as we can. A weather delay isn't a breach of our agreement.
If you need to cancel or reschedule, call us at (701) 401-8095 as early as you can. If materials have already been ordered or delivered, or forms are already set, your written agreement explains what you'll owe for that work.
New concrete needs time to cure, which is the waiting period while it hardens and gains strength before it can take weight. We'll tell you when it's safe to walk and drive on your slab. Using it sooner can damage it, and that damage isn't covered.
Payment
Your written estimate or agreement sets out the deposit, if any, when payments are due and how you can pay. Final payment is due when the work is complete unless the agreement says otherwise.
If a payment is late, we may pause work until it's settled. Where North Dakota law allows, unpaid balances can lead to collection costs or a lien on the property where the work was done.
Your property and the job site
You agree to give our crew and our delivery trucks reasonable access to the work area, and to tell us about anything buried there that you know of, such as sprinkler lines, septic parts, private wiring or pet fences. We'll ask for public utilities to be marked before we dig, but private lines are your responsibility to point out.
Concrete trucks are heavy. We'll take care getting in and out, but we aren't responsible for damage to lawns, curbs or existing driveways along the route the truck has to take, unless we caused it by being careless.
You're responsible for getting any approval your homeowners association requires. If a permit is needed for your job, check with the city, and ask us about it at your estimate.
What concrete does over time, and our warranty
Concrete shrinks as it cures and moves with freeze and thaw, so some small cracks are normal. We cut control joints, which are grooves that give the slab a place to crack in a straight line, but they guide cracks rather than stop them. Hairline cracks, slight color differences and small surface marks aren't defects.
Your satisfaction matters to us, and if something about your work concerns you, call us and we'll come look at it. Any written warranty for your job is the one stated in your agreement. Beyond that, and as far as North Dakota law allows, we don't make other promises, spoken or implied, about how the concrete will look or perform.
A warranty doesn't cover damage from de-icing salts, heavy equipment or loads the slab wasn't built for, ground movement or drainage changes after we leave, or repairs and changes made by someone else.
Limits on our liability
As far as the law allows, Williston Concrete is responsible only for direct damage we cause, and only up to the amount you paid us for the work involved. We aren't responsible for indirect losses, such as lost use of your property, lost income or other costs that follow from a delay or a problem with the job.
Information on this website is offered as is. We work to keep it accurate, but we don't promise it's complete or current, and we aren't responsible for decisions made on it alone.
Settling a disagreement
If you're unhappy with anything, call us first at (701) 401-8095 or reach us through our Contact page. Most problems get sorted out in a conversation on site, and we'd rather fix it than argue about it.
If we can't settle it that way, either side may take the matter to a court with jurisdiction in North Dakota.
Governing law
These terms and any work we do are governed by the laws of the State of North Dakota.
Changes to these terms
We may update these terms from time to time, and the version posted on this page is the one that applies. Changes don't affect a job you've already signed for, because your written agreement stays in place for that work.
